Terms And Conditions

Welcome to Tucker Collective. By purchasing a pass or membership, booking a room, entering the premises, or using our services (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”). If you are accepting on behalf of a company, you represent you have authority to bind that company.
1) What Tucker Collective Is (and Isn’t)
- Flexible workspace & amenities. We provide shared desks, private/dedicated desks, meeting rooms, internet, kitchen access, printers, and related services as described on our site or in your plan.
- Not a lease. Your membership is a service license, not a tenancy or lease. We may reconfigure or relocate seating/rooms as needed.
- Community standards. You must follow our Member Etiquette and posted house rules (collectively, “Policies”). If these conflict, these Terms control.
2) Plans, Passes & Bookings
- Membership terms. Plans renew month-to-month unless canceled as described in §8. Day passes and hourly bookings are one-time purchases.
- Access hours. Access depends on your plan. After-hours access (if included) is for the member only—no guests after hours.
- Room bookings. Book the appropriate room for your group size and end on time. Overage past your slot may incur fees or auto-bill at the then-current hourly rate.
- Guests. You may host guests in meeting rooms/common areas while present. You are responsible for guest conduct and any damages.
- No pets (Service Animals Only). Pets are not permitted anywhere inside Tucker Collective. Service animals trained to perform tasks for a person with a disability are welcome. Emotional-support/comfort animals are not service animals under the ADA.
3) Included Amenities & Fair Use
- Internet. Use our network responsibly—no illegal downloads, spamming, hacking, mining, or high-risk activities. We may manage bandwidth and block harmful sites/services.
- Printing & supplies. Any included credits are subject to fair use; overages may be billed at posted rates.
- Kitchen. Clean as you go; label food; unmarked items may be discarded daily.
4) Security, Access & Safety
- Access credentials. Do not share door codes, badges, or app access. No “tailgating.” We may log access for safety.
- Personal property. You are responsible for your belongings. We are not liable for loss, theft, or damage to personal items left on site.
- Emergency & compliance. Follow staff direction during drills/emergencies. Do not block exits or misuse equipment.
5) Mail & Package Handling (if included in your plan)
- Receiving. We accept mail/packages addressed to your name/company on file only. Oversized/unsuitable items may be refused.
- Pick-up. Please collect promptly. After 30 days, we may return to sender or dispose. We are not liable for carrier delays or loss once delivered to us.
6) Conduct & Community
- Respectful behavior. Harassment, discrimination, or disruptive behavior is prohibited. Keep noise reasonable; take calls in booths/rooms.
- Privacy. Do not record or photograph other members without consent. Use rooms for confidential calls.
- Compliance with law. No illegal activity, controlled substances, or hazardous materials.
7) Fees, Billing & Authorizations
- Payment method. You authorize us (and our processor) to charge your card/bank on file for recurring membership fees, bookings, add-ons, overages, taxes, and any damages per these Terms.
- Auto-renewal. Memberships auto-renew monthly on the same day of month as your start date (or nearest business day).
- Proration. Mid-cycle upgrades may be prorated; downgrades take effect next renewal.
- Late/failed payments. If a payment fails, access may be paused until resolved. Late balances may incur a late fee and collections costs.
- Chargebacks. Filing a chargeback without first contacting us to resolve a good-faith dispute may result in suspension and fees we incur.
8) Changes, Pauses & Cancellations
- How to cancel. Email or use the member portal to cancel with at least 14 days’ notice before your renewal date (unless your agreement states otherwise). Cancellations take effect at the end of the current billing period; no refunds for unused time.
- Pausing. Pauses are not guaranteed; if allowed, fees or minimum terms may apply.
- Our changes. We may update Plans, Policies, or these Terms. Material changes will be posted on the site; continued use after the effective date constitutes acceptance.
9) Damage, Repairs & Fees
- You break it, you fix it. You are responsible for damage caused by you or your guests beyond normal wear. We may repair/replace and charge your payment method.
- Clean-up fees. Excessive cleaning or improper use of rooms/equipment may incur a fee at our then-current rates.
10) Intellectual Property & Content
- Your content. You retain ownership of content you create. You grant us a limited license to process/store data only as needed to provide the Services.
- Our IP. Logos, brand elements, site content, processes, and documentation are owned by Tucker Collective or its licensors. Do not copy or misuse.
11) Photo/Video in the Space
- We occasionally capture photos/video of events/space use. By entering, you consent to incidental capture for TC marketing and community updates.
- Opt-out: If you prefer not to appear, tell staff at the time and we’ll do our best to accommodate/no-post.
12) Privacy & Data
- We collect and use information per our Privacy Policy (posted on our site). We use reputable processors for payments and access control.
13) Disclaimers
- As-is services. The space and services are provided “as is,” “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
- No guarantee of results. We do not guarantee uninterrupted internet, power, or availability, though we work hard to keep everything running smoothly.
14) Limitation of Liability
To the fullest extent permitted by law, Tucker Collective, its owners, and staff are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid to us in the three (3) months immediately preceding the claim. Some jurisdictions do not allow certain limitations; where prohibited, the limitation applies to the maximum extent allowed.
15) Indemnification
You agree to indemnify and hold harmless Tucker Collective, its owners, and staff from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your or your guests’ use of the Services; (b) your breach of these Terms or Policies; or (c) your violation of law or third-party rights.
16) Insurance & Waiver of Subrogation
We carry standard commercial insurance for the premises. You are responsible for insuring your own property and operations. To the extent permitted by your policy, you waive and cause your insurer to waive rights of subrogation against Tucker Collective.
17) Suspension & Termination
We may suspend or terminate access immediately for non-payment, policy violations, safety/security concerns, or unlawful activity. If terminated for cause, fees paid are non-refundable.
18) Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g., severe weather, power/internet outages, governmental actions, labor disputes, pandemics).
19) Dispute Resolution; Class-Action Waiver
- Good-faith resolution. Contact us first—we’ll try to resolve informally within 30 days.
- Arbitration. Except for small-claims matters, disputes will be resolved by binding arbitration in Shelby County, Tennessee, under AAA rules. Each party pays its own fees unless the arbitrator awards otherwise.
- Class-action waiver. Disputes must be brought individually, not as class actions or representative suits.
- Injunctive relief. Either party may seek temporary injunctive relief in court to protect confidential information or IP.
20) Miscellaneous
- Governing law. Tennessee law (without regard to conflicts rules).
- Severability. If any provision is unlawful or unenforceable, the remainder remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver.
- Assignment. You may not assign your membership or rights without our written consent.
- Notices. We may send notices to your email on file or via the member portal; you may notice us via support email listed on our site.
